School Law: EDCI 638
School Law has been one of my most informative classes. I feel like there is so much that I wasn't aware of. Understanding the court system and how laws are created and changed based off of court decisions opened my eyes. Even though it is all so complicated and technical, I was happy to have the opportunity to read a ton of court cases and see for myself how well the judges explain their decisions in writing. Even though I don't always agree with their opinions they do a great job of explaining why they made their decisions and in this way they set up precedent for future law and cases. I also find it very interesting that the high courts get to choose what cases they actually take on. I guess it makes sense that they can't take on every case, so I find it interesting and like to find out their reasoning for taking on specific cases.
As a future school leader I know that what I learned in this class will guide my decisions. It will be important to keep myself up to date on current law and current cases that effect my administration. Doing this will help me assess ways we as a school can avoid conflict and problems that will end up in court. This will bring me professionalism that will help me fulfill my job and responsibilities as I answer to the board and strive to manage precious resources for the best education of students. Everything that I learned in this class will help me to write policy and create procedures that align with what is constitutionally and statutorily correct in relation to compulsory education, curriculum, student freedom of expression, student discipline, equal educational opportunity, students with special needs, school finance, employee rights, teacher rights, collective bargaining, contracts, and torts.
I know that education law is continually being revised. In my current school I have had several opportunities to discuss several issues. One is our policy on student drug testing. We have a major problem in Guernsey, and need to take more action on this. We just need to make sure we align our policy with what is permissible according to law. Another example is regarding hiring a new principal. I took part in a committee that chose our new principal, and we had to be really careful not to judge someone because they were old, young, or in any way that would be prejudice or racist. It wasn't hard, we just had to make a conscious effort to avoid that. I have learned that you must be careful and know what is permissible so you won't be afraid to act when needed for the safety and security of the students.
